Learning & Training Terms and Conditions

These Terms and Conditions (T&Cs) apply to all learning and training programs of Conceptavision Pty Ltd (ACN 603 979 880) (“Conceptavision”), which includes but is not limited to:
On-demand courses – all on-demand bundles and digital access to on-demand courses (On-demand Courses).
Live courses and events – Camera presentation skills training and professional development events (including webinars and conferences).
When enrolling online in non-award programs of Conceptavision, and by ticking the Terms and Conditions box, you agree to the following:

Intellectual Property

All course content remains the copyright of Conceptavision or is provided under licence. No course materials may be reproduced, distributed or copied in any form or by any means without the express written permission of Conceptavision and/or the relevant copyright owner.
Nothing in these Terms and Conditions should be construed as granting any licence or right of use of any trademark without the express written permission of Conceptavision or the relevant trademark owner.

Privacy

Conceptavision collects personal information for registration purposes and distributing information in relation to courses and events, and in improving our services to you. If you require changes to your registration details or you would like to be removed from future mailings, please contact us by phone 1300 614 784 or email info@conceptavision.com.

Content Disclaimer

The opinions expressed by presenters or facilitators are not necessarily those of Conceptavision. We are not responsible for the accuracy or correctness of information or opinions offered by presenters at live programs or in recordings of live programs.  

All content and information within our non-award programs (live and on-demand) is educational in nature. It is not to be relied upon as a definitive or exhaustive statement of the law or practice, and it is not to be taken as legal or professional advice or a substitute for the same. While every effort is made to ensure that our content is up to date and correct at the time of publication, you rely on the content and information at your own risk and we are not liable for any loss of damage arising from any such reliance.  

Liability

The maximum liability of Conceptavision under these terms and conditions for any reason whatsoever arising in contract or tort or any other cause of action is limited to the relevant total course fees paid by the customer, provided that the customer notifies Conceptavision of any such cause of action within 30 days of the same being identified by the customer.

Online Delivery

You are responsible for having the necessary equipment, internet connection and applications to access programs with an online delivery component. We are not responsible for your inability to engage with a program due to the failure of your equipment, inability to access certain applications or problems with your internet access/connectivity.

Access To Course Information

Customers (individuals or organisations) may be able to view current program entitlements and customer account details via online course login. Program entitlements may only be allocated to an individual once and are not transferrable, unless otherwise authorised by Conceptavision. 

Organisations that purchase access to programs and allocate that access to its employees may have access to course attendance/usage/progress information of the individuals to whom access is granted via online course login or may request such data in its capacity as a customer.

Prices And Special Offers

All prices are in Australian Dollars ($AUD) and inclusive of GST unless otherwise specified.

Conceptavision may from time to time make special offers, including discounts, on certain programs at its discretion and may discontinue the same at any time without notice. Such offers include but are not limited to:

  1. product bundle discounts;
  2. discounts offered to past, present and prospective clients;
  3. discounts offered to organisations for multiple enrolments; and
  4. time-period specific discounts.

If more than one special offer is available on a particular program/s, only one offer (the offer of the highest value) will apply to a transaction.

All discount codes must be entered at the website shopping cart at the time of purchase. Discounts cannot be retrospectively applied to completed transactions.

Issuance Of A Statement Of Completion

The programs are not accredited and do not provide qualifications recognised by the Australian Qualifications Framework, or prerequisite qualifications for university degrees or enrolment purposes.

After successful completion of a program, course participants are entitled to receive (via email only) a Statement of Completion.

Payment Terms And Bookings

For individual customers, payment is due at the time of purchase via the website and your place in the program will be automatically allocated upon payment.   

Places in programs are not secured until we have received payment.

In the case of Live Courses and Events, if you fail to pay your invoice before the course start date, your order will be cancelled.

In the case of On-demand Courses, access will be granted when we have received payment for the Course.

Payments are processed by our third-party payment processors (currently Stripe and PayPal). We do not directly collect or store your full payment card or account details. If we are unable to successfully process your card payment or receive payment, your order will be cancelled.

You must not pay, or attempt to pay, for courses, products or services through any fraudulent or unlawful means.

Bookings are made through the calendar booking tool on our website (currently powered by HubSpot) or as otherwise agreed with you, and are confirmed once full payment (or, where we offer this, a deposit) has been received.

Workshops may be delivered online (currently via Zoom, or another video conferencing platform we choose) or in person, as specified at the time of booking.

Workshop fees are as set out on our website at the time of booking, or as otherwise agreed with you in writing, and cover your attendance and any materials described on the Workshop’s booking page, unless stated otherwise.

For On-Demand Courses:

Cancellations And Refunds

Refunds for On-demand Courses are considered on a case-by-case basis within 7 days of access being granted. To request a refund please send an email with a written request to info@conceptavision.com. Refund requests made outside this 7-day window will not be accepted, other than as required by Australian consumer law.

Access

Following successful payment, you will receive an electronic communication with details of how to access your On-demand Course. Access will ordinarily be provided within 24 hours of purchase.

You will retain access for 12 months from the date of purchase for all on-demand products, and where an on-demand program is described as providing “lifetime access”, this means access for as long as we continue to make that specific course available — it does not mean access for the lifetime of the purchaser. We are committing to making each On-demand Course available for a minimum of three (3) years from your date of enrolment, though the actual period of access could be shorter than three (3) years.

If we need to end, replace, or materially rebuild an On-demand Course before the end of the lifetime access period, we will endeavour to give you at least thirty (30) days’ written notice (by email to the address associated with your account) and will use reasonable endeavours to give you the opportunity to download or otherwise retain key course materials before access ends.

Online access to course content may be temporarily disrupted from time-to-time due to platform maintenance or other such issues.   

Cancellation

You can cancel your On-demand Course access by giving us notice in writing to info@conceptavision.com. If you do so, you will lose access to the program and will not be offered a refund.

Changes To Content

We reserve the right to make changes to content within an On-demand course. This may include but is not limited to:

  • updating individual course content, or
  • adding or removing individual courses or items of content.

Completion Tracking

You can track the completion of your On-demand Course through our learning management system (LMS). If actioned successfully, this will indicate the number of modules you have completed.

You are responsible for using the LMS with due skill and competence and for following all instructions provided in relation to tracking course completion, including ensuring that you select buttons such as “I have completed this course” where required.

Conceptavision is not responsible for any failure to record, track or display course completion or hours where this results from a user’s failure to correctly operate the LMS or follow completion instructions. Any inability to track course completions arising from inaccurate or incomplete use of the LMS is the responsibility of the user.

Acceptable Use

All On-demand Courses are for personal, individual use and must not be shared. Accordingly, individuals must not share personal access details with other persons.

If you are an organisation, the On-demand Courses must only be used for your internal purposes and accessed by nominated users, for whom you have purchased access on a per-person basis.

User Allocation And Transfer Restrictions

Digital on-demand access is allocated on a per-user basis and is non-transferable. Once a user has been assigned access to an On-demand Course, that access may not be transferred, reassigned, or reallocated to another individual. If an assigned user leaves the organisation, the subscription place associated with that user will lapse and cannot be reassigned or replaced.

For Live Workshops and Events:

Withdrawals, Transfers And Refunds

You are eligible for a full refund of the course fee if you withdraw no later than 7 days prior to the course start date.

A cancellation fee will apply for any withdrawals within 7 days of the course start date as follows (including GST):

Professional development events and all other Short Courses $100 per person.

No refunds are available on or after the course start date, or in the case of live webinars on the day before the webinar. 

You are not permitted to transfer your course enrolment/s to another person. 

Per Person Pricing

All pricing is displayed on per person basis unless otherwise specified. In the case of online courses, you are not permitted to purchase a single enrolment and share the videoconference details or broadcast the content to other persons. Unauthorised course attendees will be removed from the event or required to make payment in full immediately.

Please contact us in advance of a course or event if you have any questions about enrolling multiple attendees in a course.

Time Zones

You are responsible for checking the relevant attendance times and the time zone of programs at or before enrolment. Refunds will not be issued in relation to a failure to take note of attendance times when accessing live events hosted from different time zone.   

Cancellation And Rescheduling By Conceptavision

We may need to cancel, postpone or reschedule a Workshop — for example, due to insufficient enrolments, presenter unavailability, technical difficulties (for an online Workshop), or Force Majeure. Where we do so, you will be offered your choice of a full refund or a transfer to an alternative date.

We are not liable for any incidental costs you incur (such as travel or accommodation) as a result of a Workshop being cancelled, postponed or rescheduled, except to the extent required by law.

Workshop Materials And Intellectual Property

All intellectual property rights in any materials, templates, slides or other content provided to you as part of a Workshop remain the property of Conceptavision (or its licensors), unless we agree otherwise in writing.

You may use Workshop materials for your own personal or internal business purposes, but must not reproduce, distribute, resell, or use them to train or instruct others outside your organisation, without our prior written consent.

Unless we agree otherwise in advance, you must not record (by audio, video, screen-recording, photograph or otherwise) any part of a Workshop, whether attending online or in person.

Where you agree, we may record an online Workshop, and may share the recording with the person who organised the training session.

Conduct And Venue

You must comply with any reasonable directions given by Conceptavision (or, for an in-person Workshop, venue staff) for the safety and orderly conduct of a Workshop, whether you are attending online or in person.

For an in-person Workshop, we are not responsible for loss of, or damage to, your personal property at the venue, except to the extent caused by our negligence.

For an online Workshop, you are responsible for your own internet connection, device and software required to attend, and we are not liable for connectivity issues on your end.

Sample Topic

The Sample Topic is a limited sample product designed to provide an introductory experience similar to Conceptavision’s On-demand Courses.

Scope and access

The Sample Topic provides access to a limited selection of on-demand content. 

Access to the Sample Topic may be withdrawn at any time without notice.

Content inclusions

Access is limited to the On-demand Courses you enrol into and pay for at the time of purchase. Course inclusions may be changed by Conceptavision from time to time without notice.

Relationship to full On-demand Courses

The Sample Topic is a standalone product and does not convert into, or form part of, full On-demand Course access. 

Time Limits

The learner has access to the program for 12 months. However, if a learner would like to be eligible to receive a Certificate of Completion, the learner has eleven (11) months from the date of purchase to complete the program and all assessment requirements.

Issuance of Certificate

A Certificate of Completion will be issued upon request and only upon successful completion of all program and assessment requirements. No certificate will be issued for partial completion or unsuccessful assessment outcomes.

Cancellation/Variation Of Programs

We reserve the right to cancel, reschedule or modify live events and courses and to change speakers or revise content when circumstances require us to do so. We will endeavour to offer suitable alternatives. You will be eligible for a refund of the relevant course fees if a suitable alternative is not available.

No Warranty Of Outcomes

Our Programs are provided for general educational and training purposes. We take reasonable steps to ensure content is based on reputable sources and is current at the time of publication, but we do not warrant that any content is complete, free from error, or will remain accurate or up to date, and we are not obliged to (but may, at our discretion) update program content over time.

We do not warrant or guarantee that completing any of our Programs will result in any particular skill level, qualification, commercial outcome or professional result.

Our Program content is general in nature and does not constitute individual professional, legal, medical or other advice specific to your circumstances.

Force Majeure

If Conceptavision is prevented from or delayed in performing an obligation pursuant to a Program by Force Majeure, and promptly acts to mitigate or remove the Force Majeure and its effect, then the obligation to perform an obligation relevant to a Program is suspended during, but for no longer than, the period the Force Majeure continues and any further period that is reasonable in the circumstances.

In this clause “Force Majeure” means an event beyond the reasonable control of Conceptavision, which occurs without its fault or negligence.

General Provisions

Conceptavision may assign its rights arising out of or under these Terms without your consent. You may only assign these Terms with written consent from Conceptavision. This consent will not unreasonably be withheld.

Except for the right to assignment by Conceptavision provided by the prior clause, the rights created by these Terms are personal to the parties and shall not be dealt with at law or equity.

These Terms are governed by the laws of New South Wales and the parties agree to submit to the exclusive jurisdiction of the Courts of that State.
